Seller Disclosures

The purpose of a seller's disclosure is to protect the buyer from defects or problems with the home and surrounding property. The seller lists any known problems with the property on the disclosure form, giving the buyer advance notice of any repairs that may need to be made. However, in Massachusetts, sellers are not required to disclose defects to potential buyers. Sellers may do so voluntarily, but are not required by state law. Sellers are required to disclose the presence of lead paint.
Since sellers are not required to submit a disclosure in Massachusetts, you may not receive one at any point. However, a real estate company may ask the seller to provide a disclosure as part of company policy.

Whether or not you get a disclosure from the seller, there's no substitute for a thorough home inspection by a licensed and qualified professional. Most sellers simply aren't trained to look for and identify the issues that can affect the average home. Before you buy, always get an inspection.
