Redfin and Thumbtack Home Improvement Sweepstakes Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED. VALID IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY. ENTRY IN THIS SWEEPSTAKES CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

1. BINDING AGREEMENT: In order to enter the “Redfin and Thumbtack Home Improvement Sweepstakes” (the “Sweepstakes”), you must agree to these Official Rules (the “Rules”). Please read these Rules prior to entry to ensure you understand and agree. You agree that your Entry (as defined below) in the Sweepstakes constitutes agreement to these Rules.

2. ELIGIBILITY: To be eligible to enter the Sweepstakes, an “Entrant” or “You” must be a legal resident who is twenty-one (21) years of age or older living in one of the 50 United States or District of Columbia. The Sweepstakes is void in Puerto Rico, U.S. territories and possessions, outside of the U.S., and where prohibited by law. Employees and contractors of Redfin and Thumbtack, their subsidiaries, affiliates, and their respective directors, officers, employees, advertising and promotion agencies, representatives, and agents (“Sweepstakes Entities”), and members of the Sweepstakes Entities’ immediate families (parents, siblings, children, spouses, and life partners of each, regardless of where they live), and members of the households (whether related or not) of the Sweepstakes Entities are ineligible to participate in the Sweepstakes.

3. SPONSOR: The Sweepstakes is sponsored by Redfin Corporation (“Redfin” or “Sponsor”), a Delaware corporation with principal place of business at 2025 1st Ave, Suite 500, Seattle, WA 98121, USA and Thumbtack, Inc. (“Thumbtack”), a Delaware corporation with principal place of business at 360 9th Street, San Francisco, CA 94103, USA (collectively “Sponsors”). This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.

4. START DATE / END DATE: The Sweepstakes begins at 12:00 a.m. PT on March 24, 2015 and ends at 11:59 p.m. PT on April 10, 2015 (the “Entry Period”).

5. HOW TO ENTER: There are two ways to enter: (a) visit the Redfin Facebook page (https://www.facebook.com/redfin), click the Home Improvement Sweepstakes tab, register by completing the entry form with your email address, and enter your brief (no more than 500 characters) answer to “If you could fix one thing about your home, what would it be?” or (b) on a postcard (no smaller than 3 1/2 x 5 inches and no larger than 4 1/4 x 6 inches), handwrite your complete name, email address, phone number, and brief (no more than 500 characters) answer to “If you could fix one thing about your home, what would it be?”, and mail with proper postage to Redfin, Attn: Social Media Manager, 2025 1st Ave, Suite 500, Seattle, WA 98121. In addition to the foregoing, Entrants will receive one (1) additional Entry (as defined below) for liking the Redfin Facebook page (https://www.facebook.com/redfin). All Entries must be received by 11:59 p.m. Pacific Time on April 10, 2015 to be included in the Sweepstakes. A submission received using either method to enter is deemed an “Entry.” You may only enter the Sweepstakes one (1) time for the duration of the Sweepstakes, provided, however, that pursuant to this Section 5, Entrants who like the Redfin Facebook page (https://www.facebook.com/redfin) shall be entitled to a total of two (2) Entries. Except as set forth in the foregoing sentence, multiple Entries will not be accepted. All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, mutilated, incomplete, invalid, unintelligible, misdirected, postage-due, technically corrupted or garbled entries or mail, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor.

6. PRIVACY: You are providing your information to Redfin, not Facebook. Entrants agree that personal data submitted with an Entry, including name, email address, and phone number may be collected, processed, stored and otherwise used by Redfin and its affiliates for the purposes of conducting and administering the Sweepstakes.  Such personal information will not be provided to or collected by Thumbtack during the Sweepstakes.  By entering the Sweepstakes, Entrants agree to the transmission, processing, disclosing and storage of this personal data by Redfin and its affiliates.  All personal information that is collected from the Entrant is subject to Redfin’s Privacy Policy, located at: https://www.redfin.com/about/privacy-policy.

7. RANDOM DRAWINGS/ODDS: The potential winner will be selected in one (1) random drawing, to be held on April 13, 2015, from all eligible Entries received at the time of such drawing. Odds of winning depend on the number of eligible entries received at the time of the drawing. One (1) potential winner will be selected during the drawing.

8. GRAND PRIZE DESCRIPTION: One (1) winner will receive a cash award of $3,000 payable by check. Prizes are non-transferable. The prizes are provided equally by Redfin and Thumbtack.

9. WINNER ANNOUNCEMENT: The winner of the Sweepstakes will be announced on the Redfin Facebook page (https://www.facebook.com/redfin) on or before April 18, 2015. The winner will be notified by email on or about the day of the drawing. If the winner is unreachable after two (2) business days, that winner’s prize is forfeited and an alternative winner will be selected from all remaining eligible Entries. In order to be named a winner, the potential winner may be required to execute and return an Affidavit of Eligibility/Prize Acceptance Form/Release of liability and a W-9 Form upon accepting a prize. Non-compliance will result in disqualification and an alternate winner will be selected.

10. RELEASE AND INDEMNIFICATION: By entering the Sweepstakes, Entrant agrees, to the maximum extent permitted by law, to release, indemnify, defend, and hold harmless Sponsors and Facebook, their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents, at all times from and against any and all liability, claims, demands, injuries, losses, damages, costs, and expenses (including reasonable attorney fees) resulting from any act, default, or omission of the Entrant and/or a breach of any warranty set forth herein.

11. LIMITATIONS OF LIABILITY: The winners assume liability for losses or injuries caused or claimed to be caused by participating in the Sweepstakes, or by the acceptance, possession, use of, or failure to receive any prize. If the Sweepstakes is not capable of running as planned for any reason, Redfin reserves the right to cancel, terminate, modify, or suspend the Sweepstakes.

12. FORUM AND RECOURSE TO JUDICIAL PROCEDURES: These Rules shall be governed by, subject to, and construed in accordance with the laws of the State of Washington, United States of America, excluding all conflict of law rules. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with the Sweepstakes are hereby excluded, and Entrants expressly waive any and all such rights.

13. ARBITRATION: By entering the Sweepstakes, you agree that exclusive jurisdiction for any dispute, claim, or demand related in any way to the Sweepstakes will be decided by binding arbitration. All disputes between you and Redfin arising out of these Rules, shall be submitted for binding arbitration in the Seattle, WA, USA area. The parties agree to share equally in the arbitration costs incurred.

14. GENERAL CONDITIONS: The Sweepstakes are subject to all federal, state, and local laws and regulations. Redfin reserves the right at its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Sweepstakes; or to be acting in violation of these Rules.

15. WINNER’S LIST: You may request the name of the winner after April 18, 2015 by sending a self-addressed stamped envelope to: Redfin, Attn: Social Media Manager, 2025 1st Ave. Suite 500, Seattle, WA 98121. (Residents of Vermont need not supply postage).
